1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Albania Uncovered ("we", "us", "Company"), a tourism platform operating under Albanian law. By registering, browsing, booking, or otherwise using this website (albaniauncovered.com), you acknowledge that you have read these Terms in full and agree to be bound by them without reservation.

2. User Eligibility & Accurate Information

You represent and warrant that:

• You are at least 18 years of age or have the consent of a legal guardian.
• All information you provide — including your name, email address, payment details, and any content you submit — is truthful, accurate, current, and complete.
• You will promptly update any information that changes.

Providing false, misleading, or fraudulent information is a serious violation of these Terms and may constitute a criminal offence under Albanian law. Albania Uncovered reserves the right to verify any information you provide and to suspend or permanently terminate accounts where inaccurate information is detected.

3. User Responsibilities & Prohibited Conduct

You are solely responsible for your actions on the platform. You agree not to:

• Submit false reviews, fake bookings, or fraudulent payment information.
• Impersonate another person, guide, or entity.
• Use the platform for any unlawful, deceptive, or fraudulent purpose.
• Harass, threaten, or abuse guides, staff, or other users.
• Attempt to circumvent payments, dispute legitimate charges fraudulently, or engage in chargebacks without valid grounds.
• Scrape, copy, or commercially exploit any content from this platform without written permission.
• Interfere with the proper functioning of the website or its security systems.

Any violation may result in immediate account termination, reporting to relevant authorities, and civil or criminal legal proceedings.

4. Bookings, Payments & Cancellations

Albania Uncovered acts as a platform connecting travellers with independent tour guides. When you make a booking:

• You enter into a direct service agreement with the guide or service provider.
• You are responsible for reading and understanding the cancellation policy before confirming any booking.
• Albania Uncovered is not responsible for disputes arising between you and a guide, including but not limited to: service quality, cancellations, no-shows, or personal injury during a tour.
• Any payment disputes filed fraudulently or in bad faith (including unjustified chargebacks) will be vigorously contested and may result in legal action against the user.

5. No Liability for User Actions

Albania Uncovered is a marketplace platform. We do not employ, supervise, or control individual tour guides. Accordingly:

• We are not liable for any injury, loss, damage, death, illness, delay, or inconvenience arising from activities booked through the platform.
• We are not responsible for any harm arising from false or misleading information provided by users or guides.
• If you provide false information and this causes harm to another user, a guide, or Albania Uncovered, you bear full legal and financial responsibility for the consequences.
• We strongly recommend that users obtain appropriate travel insurance before participating in any tour or activity.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Albania Uncovered, its directors, officers, employees, partners, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, goodwill, or other intangible losses.
• Damages resulting from your reliance on information obtained through the Service.
• Unauthorised access to or alteration of your data.
• Conduct of any third party (including guides) on or through the platform.

Where liability cannot be excluded by law, our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Albania Uncovered and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the platform; (b) your violation of these Terms; (c) any false, misleading, or fraudulent information you have provided; or (d) your violation of any law or the rights of a third party. This obligation survives termination of your account.

8. Legal Action & Enforcement

Albania Uncovered takes violations of these Terms seriously. We reserve the right, at our sole discretion, to:

• Suspend or permanently terminate your account without prior notice for any breach of these Terms.
• Retain and disclose any information to law enforcement or relevant authorities where required or where we believe a crime has been committed.
• Pursue civil and/or criminal legal proceedings against any user who engages in fraud, defamation, harassment, intellectual property infringement, or any other illegal activity through or in connection with the platform.
• Seek full recovery of damages, legal costs, and any other associated expenses from the offending party.

We will not hesitate to take legal action where necessary. Users who attempt to deceive, defraud, or harm the platform, its guides, or other users do so entirely at their own risk.

9. Intellectual Property

All content on Albania Uncovered — including text, images, logos, design, and software — is the exclusive property of Albania Uncovered or its licensors and is protected by Albanian and international copyright law. You may not reproduce, distribute, or commercially exploit any content without prior written consent.

10. Account Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Sections relating to liability, indemnification, and legal action survive termination.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Albania. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent courts of Albania. By using this platform, you irrevocably submit to that jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
